Abstract

As a result of a recent federal appellate court decision, the 25 Percent Rule can no longer be used to derive reasonable royalty rates in patent infringement cases. Instead of such generalized rules of thumb, damages experts are now required to rely on information and data specific to the technology that is in dispute.
