A liability insurer generally has two duties: duty to defend and duty to pay. When a conflict between the two arises, a determination of the reasonableness of damages can be made through a judicial hearing. As with a civil trial, the forensic economist may be called upon to offer testimony in an evidentiary reasonableness hearing.
