A special needs trust is a legal instrument that permits a disabled plaintiff to receive settlement proceeds from a lawsuit, and at the same time remain eligible for means-tested social insurance benefits. As long as the trust funds are a supplementary resource, the disabled person’s eligibility will continue undisturbed. This article describes special needs trusts and their treatment in forensic economics assessments.
