Special Needs Trusts: Applications to Personal Injury Damages

A special needs trust is a legal instrument that permits a disabled plaintiff to receive settlement proceeds from a lawsuit, and at the same time remain eligible for means-tested social insurance benefits. As long as the trust funds are a supplementary resource, the disabled person’s eligibility will continue undisturbed.
