A forensic economist will regularly encounter the mitigation principle when offering opinions on economic damages in injury lawsuits. This article examines two rules that apply in these cases: the mitigation of damages and avoidable consequences rules. Legal theory, its applications, and case studies compare the two rules from a forensic economics point of view.
